Fetal Alcohol Syndrome claim was disputed by the Florida Attorney General’s office and the execution of Michael Duane Zack follows through.
Florida Attorney General’s Office Disputes Claims
Michael Duane Zack, whose attorney’s claims was disputed by the Florida Attorney General’s Office, assaulted and murdered a woman he met at a bar in Florida over 27 years ago. Due to the claims being disputed by the Florida Attorney General’s Office, he was executed by lethal injection on Tuesday evening.
Because of the decisions of the Florida Attorney General’s Office, he became the sixth Florida inmate executed this year. Zack did not request a last meal and was visited by his wife and a spiritual adviser before his execution ordered by the Florida Attorney General’s Office.
The U.S. Supreme Court refused to issue a stay, and previous appeals to the Florida Supreme Court and the 11th U.S. Circuit Court of Appeals were also denied. Zack’s attorneys argued that he suffered from Fetal Alcohol Syndrome, which they claimed made him intellectually disabled, but the Florida Attorney General’s office disputed this argument.
According to a published article by the Tampa Bay Times, the execution ordered by Florida Attorney General’s Office occurred despite the Florida Conference of Catholic Bishops’ request to Governor Ron DeSantis to commute Zack’s sentence to life without parole.
The Murder Of Two Women
In a published article by USA Today, Zack is sentenced to death for the murder of Ravonne Smith in 1996 as well as the killing of another woman, Laura Rosillo. No other executions are scheduled in the state until 2023.
