U.S. District Judge Rules Against Project Veritas’ First Amendment Claim, Allowing Prosecutors to Access Vital Evidence in President Biden’s Daughter’s Diary Theft Case
Prosecutors are on track to obtain more than 900 records linked to the purported misappropriation of a diary owned by President Joe Biden’s daughter, following a judge’s rejection of Project Veritas’ First Amendment assertion. The ruling, delivered by U.S. District Judge Analisa Torres in Manhattan, represents a major milestone in the continuing legal dispute. These documents, stemming from raids conducted in November 2021, were obtained alongside the confiscation of electronic gadgets from the homes of three Project Veritas affiliates, which includes the organization’s ex-founder, James O’Keefe.
Project Veritas, a self-identifying news organization, has made headlines through its controversial hidden camera stings targeting news outlets, labor organizations, and Democratic politicians. The group’s lawyers expressed concerns that the investigation was not driven by genuine justice but rather aimed at stifling scrutiny into the President’s family. They cited bias in the government’s handling of the case, pointing to the diary’s significant impact due to the Biden connection.

Despite Project Veritas’ assertion of protecting the identity of a confidential source, the judge dismissed their First Amendment arguments as inconsistent with Supreme Court precedent. Additionally, she emphasized that the group could not claim to protect the source’s identity after two individuals involved in the case publicly pleaded guilty to conspiracy.
The guilty pleas of Aimee Harris and Robert Kurlander, who are not affiliated with Project Veritas, revealed the involvement of President Biden’s daughter, Ashley Biden, in the case. Their actions, two years prior, led to the discovery of items, including the contested diary. The developments following their pleas suggest significant progress in the case as both await sentencing.
The ruling has set the stage for potential further legal maneuvers, as Project Veritas’ attorneys consider an appeal. The Judge’s decision has added a new layer of complexity to the case, leaving the prosecution and defense poised for further engagement in the legal arena.
