According to source, a judge has ruled that Abby Zwerner, a Virginia teacher shot by her 6-year-old student, can proceed with her $40 million lawsuit against the school system, alleging negligence by school administrators. The surprising decision by Newport News Circuit Court Judge Matthew Hoffman opens the door for the Virginia teacher shot by her 6-year-old student to potentially receive more than just workers’ compensation for her injuries.
The judge determined that the injuries sustained by the Virginia teacher shot by her 6-year-old student “did not arise out of her employment,” rejecting the school system’s argument that her injuries were job-related and covered under workers’ compensation.
